We've been seeing a mysterious Android 4.1.2 update mentioned in conjunction with a few unreleaseddevices in the past few hours, so it's only fitting that we're seeing the official release today. Google's Android Open Source Project lead Jean-Baptiste Queru has posted word that the 4.1.2 release should be available on Tuesday for at least those relying on pure AOSP builds of the mobile OS. While we haven't seen the update reach our own devices yet, some Nexus 7 owners already report getting 4.1.2 on their tablets with a pleasant surprise in store: in addition to the expected bug fixes and performance boosts, the software lets the home screen rotate to landscape mode on the smaller Jelly Bean slate. We're keeping an eye out for when other hardware gets the patch, although it's expected that the Galaxy Nexus, Nexus S and Xoom will follow quickly enough.

The iPhone 5 is less than a month old, but Apple is already gearing up for its next major product launch. According to the Wall Street Journal, Asian component suppliers have received orders for more than 10 million units of a scaled-down iPad, about twice the number of Kindle Fire tablets ordered for the same time period.
Dubbed the iPad Mini, the smaller tablet has been repeatedly rumored, but not actually revealed by Apple itself. The tablet will reportedly sport a 7.85-inch screen and a lower price point to stay competitive with newer tablets from Google and Amazon. Google's Nexus 7 tablet starts at $199, while Amazon's entry-level Kindle Fire retails for $159. Currently, the least expensive configuration of the iPad clocks in at $499. According to market research firm IHS iSuppli, Apple's market share of tablets was nearly 70 percent for the second quarter of the year, reclaiming ground it had lost since a wave of competitors found success early last year.
Apple is rumored to be revealing the iPad Mini later this month.

We speak with iOS developers about Apple clamping down on third-party app promotion
[h=3]Apple[/h]Established in 1976, Apple is a multinational corporation (corporate headquarters based in California)...
apple.com
A little over a week ago, the folks at PocketGamer.bizdiscovered an interesting new clause in Apple's App Review Guidelines, which could indicate Apple's intent to restrict any app that promotes titles from a different developer. It's likely that Apple is simply targeting app promotion services, and not game developers themselves, but depending on if/how Apple enforces the new clause, some game makers could have a hard time getting the promotion they need in the App Store.
Interestingly, the developers GamesIndustry International chatted with were either not worried about it or were even in favor of Apple's continual management of the App Store.
"Apple has done business this way since the 1970s. Their business model is to lock people into tightly controlled, proprietary ecosystems. They use openness only to the point that it benefits them, then increasingly clamp down with further controls. We shouldn't be surprised by it. This frankly Draconian approach is also why they provide products and ecosystems that are generally superior to their competition. They take control; sometimes it is to our benefit and sometimes it isn't. This is just the latest example of shifting toward a greater degree of control now that their business model is established and predominant," explained Dirk Knemeyer, Founder & Chairman, Involution Studios.
"I don't think it's cause for great concern," added Ernest Woo, CEO, Woo Games. "We're still planning to ship ErnCon with Flurry, Tapjoy, and Chartboost integrated for cross-promotion opportunities. If Apple clamps down on use of such SDKs for cross-promotion then us app developers will just have to get creative!"
William Volk, CCO of PlayScreen, isn't worried about the app promotion services clamp down as much as the overhaul of the App Store itself. Similar to when Microsoft revamped the dashboard and it became harder to find indie games, the new App Store design doesn't play nice with giving categories prominence.
"The bigger issue is that categories are now buried in the new App Store, so that even if you did 'buy' placement into a sub category of games, it's not going to matter as much as it used to. It takes far more clicks to even get to a category -- and when you get there, you'll see ONE app instead of 25," Volk lamented. "Ad options are likely to be limited to more conventional advertising, such as iAds, interstitials and video."
"My opinion is that management of the app store is a good thing in the long run. This is the biggest reason why apps are so much more successful in the Apple App Store than on Android"
Dave Castelnuovo
The situation is perhaps best summed up by Dave Castelnuovo, co-founder of Bolt Creative. Castelnuovo understands the concerns from both Apple's perspective and from developers. Apple wants to be able to maintain the integrity of its App Store, but developers would like to have a chance at least of some promotion. In the end, Castelnuovo sees the App Store management as a positive that game makers should welcome.
Here's his full response:
"From reading the clause, it's clear to me, that Apple only has an issue with apps that look like an 'app store' - apps that have lists of other apps where their sole goal is to make money through the affiliate program or in promoting apps for money. It doesn't apply to a non-promotional app that is just promoting another app through their news feed. Otherwise they would have to ban all mobile advertising."
"This is a tough issue to comment on. Each side has a valid point and taken to extremes, both sides can be bad for the ecosystem."
"Apple is mainly concerned with the integrity of their app rankings. They want the top spots to go to the apps that are most deserving, the ones that users actually enjoy. If it looks like the rank lists are getting stagnant and it would be a better service to users to shake things up, they want the ability, through features and ranking algorithms, to make it so users find more value in the listings."
"App promotion services can interfere with these efforts. Not always, most of the time they make such a minimal impact that it really doesn't matter, but every now and then a service comes along that has the power to radically shape the rank lists outside of Apple's control. Tapjoy was the first example of this and I agree that services like Tapjoy, which allow developers to buy their way into the top of these lists, is a disservice to consumers. Nowadays, with the whole freemium promotion craziness, I think that these apps, as a whole, are starting to make an impact that Apple can't manage."
"On the other side, you have developers with legitimate concerns about discoverability and getting their app out to the masses. If you take away their ability to effectively market and promote themselves, then they are at the mercy of Apple. They can't get sales unless they appear on a rank list, and they can't appear on a rank list unless Apple features them."
"Despite these two extremes, I think there is middle ground between the two. If Apple completely shuts down all promotion, it's bad for the ecosystem. If App portals get so powerful that they sway the rankings in favor of the companies that pay the most, it's bad for the ecosystem. But somewhere in the middle there is the right balance, I think Apple knows this but they are trying to publish a clause that they can use against the outliers that overly game the system. If you are an app that just grabs data from the app store and repackages it in a slightly different format, then you are probably hosed. If you have a really powerful promotion app that people can use to buy their way to the top, then you are also probably hosed. However, if you are an app portal that has some kind of added value, that provides a service that the app store doesn't provide and in general enhances the ecosystem, it's probably going to be a rough couple months of uncertainty and maybe a couple rejections, but I'm sure the rule will eventually be clarified and there will be a way to keep publishing your app."
"And by the way, sometimes Apple posts these clauses as a warning to developers but doesn't enforce it unless it continues to get out of hand."
"At the end of the day, if you have a business strategy that revolves around creating a discoverability portal or promotion service, you have to know what you are getting yourself into. Apple has and will change the playing field whenever they feel it best serves their interests. Look at OpenFeint, Plus+, and Tapjoy. Make money while you can, but just know that Apple can (and should if it hurts consumers) shut down your business model at any moment."
"My opinion is that management of the app store is a good thing in the long run. This is the biggest reason why apps are so much more successful in the Apple App Store than on Android."

The best thing is, you can’t bury digital games in the desert!
Chillingo and Universal have teamed up to bring the Strawdog Studios’ developed title ET: The Green Planet to iOS.
It’s available to download for free right now from the App Store.
The stumpy, stretchy-necked alien is no stranger to games, of course, though it’s safe to say that his most famous video game outing was less successful than his attempts to phone home.
ET the Extra-Terrestrial was released in 1982 on the Atari 2600 and has become notorious as being one of the worst video games ever made. Arguments over the game’s licence led to creator Howard Warshaw having only five weeks to program the title before release.
Atari’s hopes that the game would thrive regardless on the strength of the IP proved misplaced, and its colossal commercial failure is regarded as a significant contributing factor to the 1983 video games market crash.
It is believed by many that millions of unsold copies of the game were buried somewhere in New Mexico, although no concrete evidence of this has ever been found.
This new game is being released to coincide with the 30th anniversary of the film and is certainly a deviation from the 1982 outing. It takes place on ET’s homeworld and sees the plucky chap trying to save the indigenous gardens.
Players will also be able to visit their friend’s gardens.
“ET The Extra-Terrestrial is one of the greatest science-fiction films ever made and conjures up nostalgia for countless fans around the world,” Chillingo co-founder and co-GM Chris Byatte stated.
“We are excited to commemorate this global cultural phenomenon by publishing an amazing new game.”

So Apple has won a major round of its battle with Samsung, in the USA at least. The UK was slightly more level-headed about this particular spat, as were many of our EU partners, and the legal challenges are far from over around the rest of the world.
I’m not going to add my opinion about this fight, but I’m surprised that the press are treating this as though it is the first time that Apple has taken issue with the opposition, which those of us who have been Apple watchers for many years will certainly remember it isn’t.
For almost ten years from the mid-1980s, Apple had a very major partnership with Sony for many products. In 1992, every Mac model had a Sony floppy disc and CD drive installed; Apple’s professional monitors were all based on Sony’s Trinitron CRT technology; Apple’s professional scanners and its pioneering QuickTake digital camera range were all produced by Sony. More noteably, the very first true Apple portable – the PowerBook 100 – was the first complete Apple computer to be totally manufactured by a third- party company – yes, Sony again.
But in 1994, Apple and Sony fell out. Sony launched its first Vaio portable computers, and Apple claimed much of their design and operational functionality was based on Apple’s ideas. Sony also lauched its own brand of high-end professional computer monitors, and Apple claimed these copied many Apple features also. By 1996, Sony drives had disappeared from Apple computers to be replaced by Panasonic, Ricoh and Philips, and the Sony partnership was over.
However, this bust-up never went to court. Why? Because in 1994, Sony was simply too big for the then- struggling Apple to take on, and it had so much financial clout that Apple would have simply lost at the first hurdle. 1994 was also the year that Apple finally lost its high- profile battle with Microsoft over the similarities in their respective operating systems.
When Steve Jobs returned to Apple in 1995, he quickly went to great lengths to repair Apple’s relationship with both Microsoft and Sony, and put all the legal wrangles behind them, because he knew that competition was good for business. So you can’t help but wonder if this anti-Samsung movement would have gone ahead if Steve was still with us...

Production of the iPhone 5 has been halted once again following fresh disruption at Chinese manufacturer Foxconn.
Reports from Asia suggest that up to 4,000 workers at the controversial factory have staged a walkout over a dispute about forced holiday work, stopping iPhone 5 production lines at “multiple” locations.
The dispute originated from Foxconn’s Zhengshou plant and subsequently spread to three other locations. What are described as “overly strict demands on product quality” reportedly led to fights between workers and inspectors.
In typical Foxconn style, the troubles were ended on Saturday night after all those involved were threatened with the sack.
Late last month riots led to another Foxconn closure, though it was unclear whether the previous disruption affected iPhone 5 production. A recent report highlighted the terrible working conditions suffered by Foxconn’s 1m+ workforce.
The iPhone 5 continues to be in short supply in the UK, with many customers still waiting for their launch day pre-orders.

Every month we invite a member of the industry to anonymously air their grievances about whatever winds them up. This month it is all about iPhone 5.
JUST DIFFERENT ENOUGH
So, I saw that Apple had launched a new iPhone. I call it a new iPhone but let’s be honest it’s more or less the same as the old iPhone.
They slightly upgraded the processor I heard, but that’s not the point of each new gadget they come out with any more. It’s always the same with Apple, the first generation is very bare bones, but they’ll purposely leave space for a camera or something, which leaves the media wetting its collective knickers about what features they think might be in the next generation.
Sure enough, the next generation creeps through the doors, only this time that camera shaped hole is filled with a camera. And I’m supposed to be impressed by this swindle?
This latest version (the long iPhone, as I like to call it) is nothing new. So they made the screen wider. So what? The biggest difference between this generation and the last is that there is sufficient difference between the two cases so that people can tell you have the latest model at a glance.
Because that’s all it is with most iPhones – take it out and wave it round. Make sure everyone else knows that you paid top dollar for the latest gizmo.
The next iPhone will have something else silly. I’d put good money on it. My forecast is that it’ll have some distinctive case design like indented corners or chrome edging or something that jumps out at first glance to identify itself as new, just so that some easily impressed people can find self worth.
The iPhone is nothing more than a vanity piece for shallow people. The fact that it’s done so well makes me weep for the future. Sent from my Galaxy S3.

Sega has announced Dreamcast classic Crazy Taxi will be available on Apple's iOS devices soon and released a trailer.
For the unfamiliar, Crazy Taxi is all about tearing around a city picking up fairs and dropping them off against the clock to rack up cash and high-scores.The game was released for arcades in 1999 and made its way to Sega's Dreamcast a year later. This was followed by a PS2 and GameCube release in 2002 and a digital releases on PSN and XBLA in 2012.

NYTimes has an interesting article about how patents are really stifling innovation in the tech industry. Today, almost every major technology company is involved in ongoing patent battles. Of course, the most significant player is Apple, industry executives say, because of its influence and the size of its claims: in August in California, the company won a $1 billion patent infringement judgment against Samsung. Former Apple employees say senior executives made a deliberate decision over the last decade, after Apple was a victim of patent attacks, to use patents as leverage against competitors to the iPhone, the company's biggest source of profits. At a technology conference this year, Apple's chief executive, Timothy D. Cook, said patent battles had not slowed innovation at the company, but acknowledged that some aspects of the battles had 'kind of gotten crazy.' It is a complaint heard throughout the industry. The increasing push to assert ownership of broad technologies has led to a destructive arms race, engineers say. Some point to so-called patent trolls, companies that exist solely to sue over patent violations. Others say big technology companies have also exploited the system's weaknesses. 'There are hundreds of ways to write the same computer program,' said James Bessen, a legal expert at Harvard. And so patent applications often try to encompass every potential aspect of a new technology. When such applications are approved, Mr. Bessen said, 'the borders are fuzzy, so it's really easy to accuse others of trespassing on your ideas.

Back when Google ecstatically unveiled its 7-inch Nexus tablet a few months ago, the company decided to keep things simple by only introducing 8GB and 16GB models -- much to the dismay of folks who prefer a device with a bit more storage space. One lucky customer in Japan, however, claims to have unexpectedly received a Nexus 7 loaded with more built-in storage than Mountain View currently advertises, having been delivered Google's Jelly Bean-packing slate with 32GB instead of the 16GB unit that was ordered. Interestingly enough, the surprise delivery comes at a time when Google is rumored to launch a new, more spacious 32GB model as soon as October 24th -- though only time will tell if that'sactually going to be the case.

Nearly half of users are unnecessarily vulnerable to attack, with just 54 per cent of users able to pass a basic mobile device security test.
Almost half of UK mobile users are dimwits when it comes to security.
A study from knowthenet.org.uk has found that 46 per cent of people cannot pass a simple mobile security test.
The survey shows that 27 per cent of people aren't aware that they need to protect their mobiles, 31 per cent don't know how to, and 19 per cent don't even think it's necessary.
Other worrying results include:
- 21 per cent of 16-24 year-olds have been phonejacked
- 17 per cent have clicked on unknown links sent to their devices
- 19 per cent are happy to log on to unencrypted wi-fi connection
In the UK, 120,000 smartphone are stolen each year, highlighting the importance of making sure yours is secure should the worst happen.
Phil Kingsland, site director at knowthenet.org.uk, said: "The prevalence of mobile devices is making them a target for cybercrime. The personal and sensitive information stored on the devices, their portable nature and a failure to view them as a target for crime means users in the UK are now vulnerable to device fraud and security lapses.”

As iPlayer Radio is launched for iPhone, the BBC says it is also going to develop an app for Android, but that's it.
In a bid to revamp its online audio, the BBC has created a version of the popular iPlayer for its radio stations.
iPlayer Radio will see content taken out of the iPlayer and offered instead via a separate desktop and mobile service.
An iPhone app is will be available later today, with Android due to follow shortly.
However, the BBC says it has no plans to create apps for other platforms, including Windows Phone and BlackBerry. The iPad is missing too, but that won't be for long. In the meantime, the browser-based website has been built to work on any screen size.
The iPlayer Radio app will be restricted to UK use only at the moment, but the PC version will be available globally.
Commercially, given how small the BB and WinPho user bases are, it makes little sense for the Beeb to invest in platforms outside of iPhone and Android, but it's just another example of how far BlackBerry's star has fallen and how much ground Microsoft has to gain if it wants Windows Phone to be a true competitor.

"Use your hand to shade the lens. Or don't take pictures of bright things. Whatever. Just give us your money."
When the iPhone 5 finally made it into users' hands, some were quick to complain - many of their pictures seemed to include astrange purple glare or halo.
Whenever a bright light was in the frame, a lilac flare would appear in the final photo, which is not ideal.
Now, Apple have released an official explanation, and offered some advice to those troubled by the unwanted auras:
“Moving the camera slightly to change the position at which the bright light is entering the lens, or shielding the lens with your hand, should minimize or eliminate the effect.”
Not all that helpful, really.
The company has already stated that the purple flaring is considered to be "normal" behaviour for the iPhone 5, and this latest statement is not likely to satiate disgruntled consumers.
A splash of purple in your pictures isn't the end of the world, but when you've a good chunk of your monthly salary on a new phone, it shouldn't have problems like this, should it? And it's definitely noticeable; see the picture below.

Foxconn has ambitious plans to deploy a million-robot army on its assembly lines. But while robots already perform some basic tasks, when it comes to the more delicate assembly work, humans still have the edge. George Zhang, senior principal scientist with ABB, a major vendor of industrial robots, thinks Foxconn will eventually replace human workers for much of its electronic assembly, but probably not in time for the iPhone 6. For now, humans are still a cheaper and more practical choice.
