The US Justice Department was insistent that its proposed injunction against Apple for alleged e-book price fixing was the proper remedy earlier this month, but it's now willing to budge on that somewhat. As Reuters reports, the DOJ has offered to cut the length of the injunction from ten to five years, and ease the restrictions on Apple striking new deals with book publishers -- it now suggests Apple hold staggered negotiations with publishers starting in two years. The DOJ continues to insist on the need for an external monitor to keep an eye on the company, however, which remains a non-starter for Apple.
The company also drew some particularly harsh criticism from the DOJ, which stated in a filing that "Apple wants to continue business as usual, regardless of the antitrust laws," and that "this court should have no confidence that Apple on its own effectively can ensure that its illegal conduct will not be repeated." For its part, Apple isn't commenting on the DOJ's latest proposal.

Gone are the days of bizarre phones with some special practical use, but not all hope is lost. Earlier today, this author stumbled upon a shanzhai Android 4.0.1 phone with a built-in power plug! It's a bit awkward, though, as you have to take off the back cover to flip up the Type A plug -- we're assuming it has a world-friendly voltage rating, but we'll double check. Should you wish to juice the phone up the old-fashioned way, the micro-USB port is still there.
Externally, this Daxian N100i seems to be very much "inspired" by the Xiaomi Phone 2or 2S. Given the HK$599 (about US$80) price point (or about US$40 each in bulk), don't expect too many goodies from this outlandish candy bar: there's a dual-core 1GHz MT6517 chipset, a 4.3-inch 800 x 480 TN display, 4GB of storage, a microSD slot, an 1,800mAh cell (plus a spare in the box) and dual-SIM slots -- but for GSM 900/1800 only. The front and back cameras both have a resolution of just 3.1 megapixels, and it was hard to judge the picture quality on that horrible screen. Still intrigued? Google occasionally updates its Play Store rules to weed out inconsistent or shadybehavior in Android apps, and we're witnessing one of its larger clean-ups today. The company's new guidelines more explicitly ban device interference: titles in the Play Store can't modify settings or other apps without permission, and they can't install bookmarks or icons that pitch a third-party service. Google is also adamant that any in-game purchases of virtual goods must go through its billing system. As usual, new apps have to follow these guidelines right away, while developers with existing apps have a 30-day grace period to make any changes. The policies won't necessarily stoprogue code from sneaking into the Play Store, but Google can at least say that it gave fair warning.

When we spotted this photo on French blog NoWhereElse, we were close to dismissing this as just a bunch of iPhone 5C knock-offs (the shanzhai industry works very fast), just as the site also speculates. But after digging around the original poster's Sina Weibo profile, we deduced that this spy shot came straight out of Pegatron's Shanghai plant, which matches what we've read in the recent China Labor Watch report on Apple.
According to her posts, the cheeky employee -- or more likely an ex-employee at this point -- in question joined the company's quality control department around mid-July. In an earlier comment, she also hinted that her plant is responsible for the latest Mac mini as well. The above photo was published yesterday, and it only came with the following caption:"The low-end iPhone 5C to be launched for Chinese consumers in September doesn't look much different than the Xiaomi Phone 2, right?"
While it doesn't explain what's going on in the image, this appears to be a typical warm-up procedure to make sure the devices are fully functional before they are boxed up. We've seen this in factory tours before, but no photography was allowed in the production lines; which makes us wonder how this shot came out of a supposedly well-guarded environment. September couldn't come any quicker for leaky Apple.

Insiders discuss whether the situation is all that bad, and what Ouya should do next
Ouya's animated ad featuring a vomiting gamer hasgarnered a great deal of negative comments since it briefly appeared on Ouya's YouTube channel earlier this week. The [a]list daily reached out to some PR and marketing veterans in the game industry to get their reactions and advice for Ouya.
Scott Steinberg, head of video game consulting firm TechSavvy, offers some straightforward advice to Ouya. "Ouya's best strategy at this point is to acknowledge, explain, address and apologize for the issue. As a company, it needs to acknowledge that there's a disconnect, explain how the issue occurred, address viewers' concerns, and apologize for the mistake," said Steinberg.
Another marketing executive who's been in the game industry for many years wonders about the way the ad is targeted. "This doesn't appear to be part of a market research test. The ad is pretty much done, other than perhaps an end slate and call to action. BUY NOW!," said the exec, who wished not to be named. "It completely misses the consumer benefit part of the proposition and relies solely on gamers' 'disgust' over bad and remade games that aren't different from their predecessors. Everyone is talking about a bad ad and there's nothing in it that sets Ouya apart from the competition. They're using words like amateur, crass, gross, disgusting...nothing that you'd want your brand associated with. They could have talked about their $99 price point, their Android operating system, their FREE games that will never burn your wallet, their appeal to the common man...anything."

From a PR standpoint, Ouya's ad may not be all bad news. "Anytime people are talking about you, people are talking about you. So that's good, right?" said a veteran PR executive who has dealt with a wide range of games with a variety of publishers. "Particularly when everyone is mostly talking about your two competitors (to be kind), who are about to outspend in marketing the entire net worth of your company by a factor of 10X."
There's nothing like some examples from the history of video game advertising to put Ouya's ad into perspective. "The spot itself reminds me of90's-era advertising (especially the stuff that came out of the UK), where ads were taken to controversial eXXXtremes in order to seem 'authentic' or grab the attention of the mysterious gamer but really just came across as eye-rolling,Poochie-style cultural whiffs," said the PR exec, citing numerous examples. "Does it fall flat? Absolutely. But this also explains why it wasn't front and center on Ouya's website, Facebook page, YouTube channel, Twitter account, Vine, Vimeo, Instagram, etc."

Mobile game revenue rose four times that of other gaming devices.
Spending on games via the iOS App Store leads the way in the first and second quarter of this year, double that of Google Play but even more so, than that of handheld consoles such as the Nintendo 3Ds and Sony's PSP, reports App Annie.
The changes in smartphone marketshare, and consumer spending across mobile and handhelds is changing course rapidly.
In the first quarter, Google Play saw less income than its dedicated gaming platform rivals, however during the second quarter, spend on the latter dipped and Google saw its app store increase a considerable amount taking second place behind Apple's App Store.
In related news, one of the biggest arcade game developers, Namco - creator of PacMan and Tekken - is even embracing mobile gaming with open arms as it opens an office in Vancouver, dedicated to the production of mobile and online games. Could this avenue of 'traditional gaming' be another victim of the app-ocalypse?
Back to the data at hand - there is still a long way to go for Google Play to catch up with the ultimate iOS app leaders, yet our trusty Gameboys and PSPs look to be heading for an early-ish retirement.
Is there anything they could do to regain the gamers attention? Only time - and an unforeseen complete global app store blackout - will tell!

One-in-ten children have a mobile phone by the time they’re five, with the average Brit kid getting a mobile around the age of 12.
The figures, which have emerged in research fromuSwitch.com, also show that 15 per cent of kids under 16 years old have a phone worth more than their parents. Most parents, however, spend an average of £246 on their phone, almost double the amount the £125 they spend on their children’s. Monthly costs also sit higher for adults – roughly £19 a month compared to the £11 spent on their kids’ contracts.
Despite the average combined cost of a mobile for their kids running up to over £250 a year, almost half (42 per cent) of parents don’t keep a track of their children’s phone spending, with only a quarter capping data.
Ernest Doku, telecoms expert at uSwitch, says that asking the network to cap your child’s data is "very sensible", also reminding parents to ensure that at home Wi-Fi is used, instead of mobile data connections such as 3G and 4G, to avoid racking up additional costs.
"Asking networks to place caps on [kids’] mobile bills takes about five minutes," said Doku.
With an easy way to limit extra charges, parents can allow their children to socialise and have emergency contact, without having to phone for help themselves.

Delta Air Lines has completed a deal with Microsoft, Avanade and AT&T that will see over 19,000 of its flight attendants use Windows Phone 8 devices.
Attendants will use the Nokia Lumia 820 to process customer payments mid-flight, arrange e-receipts, read coupons displayed on a customer's mobile device (in the future) and more, to "streamline on-board purchasing".
The agreement includes plans to expand the solution over the next three years to include the newest Nokia devices.
The Windows Phone 8 devices have been tailored for Delta staff by Avanade using the Microsoft Dynamics for Retail mobile point-of sale platform. It will operate over Wi-Fi and AT&T's 4G LTE Network.
The solution was developed after months of development and feedback from flight attendants.
"Delta's 19,000 in-flight professionals are there for the safety and comfort of our customers, and equipping them with innovative solutions means they can better meet our customers' needs on board every flight," said Joanne Smith, Delta's senior vice president for In-Flight Service.
"This is yet another way we're investing in technology to improve the customer experience."
The new handheld device is Delta's latest investment in technology, following its Fly Delta app for iPad, the launch of a new delta.com website in December 2012 and revamped self-service kiosks in September 2012. Delta also offers Delta also offers in-flight Wi-Fi on board more than 800 aircraft.

Yes, new rumors about iPhone colors seem to come along every day now. But these images from Weekly Ascii in Japan show an intriguing look at the champagne version of the alleged iPhone 5S model allegedly coming September 10, next to black and white iPhone 5 models... allegedly, of course. If real, they match up with previous images, while also showing a bit more refinement in the design and quality. The new color would be far from the blingy gold we saw before, though, perhaps ruining the dreams of the Chanel-bag-and-small-dog crowd. Well, Apple has a bit of egg on its face right now. Seems as if an update to the Find My iPhone app has been pushed out to some devices before it was ready for consumers. The update brings that pretty new matte icon that is part of the iOS 7 make over, but it also brings with it the inability to log in to the service without a developer account. That's right, this update was meant only for devs, but it's being pushed out to at least some members of the public. When users go to try and log in an error message pops up informing them that "you must be a registered iOS developer and have iCloud configured on iOS 7.0 Beta to use this version of Find My iPhone." We've reached out to Apple from comment, we're expecting something along the lines of "oops...
Update: Apple hasn't issued a formal statement, but we've been told the issue has been fixed. Best of all, there's no update required -- users who have updated should just be able to log in now.

What do teenage girls think about BlackBerry, in-app purchases, Android and more? I asked some…
I'm on holiday in a remote corner of Wales, cut off from mobile connectivity and therefore unable to check the important things going on in the outside world. Football transfer rumours for example.
I've also little idea what's going on in the mobile space, which makes it tricky for me to comment on the week's big news.
So instead, I quizzed three youngsters about their phone habits. They are Lois (16), Marnie (14) and Lucy (12).
If you're a BlackBerry exec I suggest you don't read any further…
What phones do you and your friends have?
M: iPhone. And so do nearly all my friends.
Lo: I have an iPhone and I reckon four of 70 friends I can think of have a BlackBerry. Nearly all the rest have iPhones.
Lu: I've got a BlackBerry and I absolutely HATE it.
Why?
Lu: It freezes all the time, the camera's terrible. It's not even that old – less than a year.
I assume you all had BlackBerrys before. When did people start switching?
M: Last Christmas. Everyone started changing then. Now, anyone who's coming to the end of their contract wants an iPhone.
Are you aware that BlackBerry has completely changed its phones?
Lo: I've seen adverts, but I've never seen anyone using one. It's funny that two years ago everyone knew when there was a new BlackBerry out and they all wanted one. Now, no one's interested.
Is there anything you miss about BlackBerry?
Lo: I like the keyboard. You get used to touchscreen, but I still miss it.
M: But the noise was annoying. I like the way you can turn off the sound with iPhone. And iPhone's just look so much sleeker.
Lo: There's still nothing on iPhone to replace BBM. It was brilliant the way you could get status updates and post your profile. Everyone was on BBM so you could get an instant idea of what was going on all the time.
M: And if you were bored you could send out a broadcast and you'd always get a response. I've tried Peeem, but no one really uses it. It's a bit crap.
Do you know that BBM is coming to iPhone?
Lo: That would be amazing. But why would they do that? It's the one thing people love about BlackBerry. I would definitely try it.
What about Android? Do you have any friends with Android phones?
Lu: Is that like HTC and Sony? The big fat phones?
(at this point I explain Android – none of them has a clear idea what it is)
Lo: Some boys have got Android phones, but none of the girls.
M: I don't know anyone with one.
What about Nokia Lumia?
Lu: I know one boy with one. I don't think he had any choice.
Lo: Lots of boys have cheap Nokias. There are still quite a few boys who don't really care about their phones. But not girls. If you see a girl with a Nokia 'banger' you know it's because her main phone is broken or confiscated or something. And you really want something crap when your main phone is out of action. You don't want an average phone in case people think it's your main phone.
How many texts and iMessages do you send a day?
M: Over 50. But I don't even think about whether it's a text or an iMessage. I just go into messages and send it. If I've got wifi it's iMessage.
Do you still use Skype?
M: As soon as you get an iPhone you don't use Skype any more. Just Facetime.
Do you ever feel like you've wasted your time by using your phone all day?
Lo: It is possible to just go on forever. There's always a new notification to reply to or something on YouTube to check out. Sometimes I do get fed up with it, and just go off an do something else.
M: At least it's sociable. It's not like spending hours on Minecraft, which is just pointless and sad.
Lu: I'm not addicted to my phone, but I am addicted to my iPad. The school gave us all iPads, and all we ever use them for is Instagram and SnapChat and YouTube. Everyone's connected all the time. They must have thought it would help us with learning but it's completely backfired. They even tried to change us to a new wifi signal but we knew it would block off lots of content, so we all carried on using the old one.
Have you ever bought anything from an app? And do you know your parents' passwords?
Lu: My mum hasn't got a clue how to set up an iTunes account, so no. I've bought stuff with gift cards.
M: I don't know my parents' passwords, but they have bought things for me.
Lo: I've got my own account with my own debit card. But I've hardly bought anything. It's stupid but I see '69p' and I think it's too much. It's ridiculous to think that.
M: Yeah, and sometimes the paid version is to block ads. I don't know anyone who would pay for that. You can just ignore ads.
Lo: I've never paid for music. I used to use Limewire, but now I record YouTube.
M: Everyone uses the Music Tube app. Since that came out, hardly anyone buys from iTunes.

Developers and consumers chide video for take on gamers and attack on competitors
Android console firm Ouya has found itself the subject of derision over an advert for the hardware posted on its official YouTube channel.
Swathes of people have ridiculed the video online, which depicts a gamer getting increasingly infuriated over the cost of a $60 game.
The animation finished by stating players should “stop wasting cash on crappy games”, pointing to the free-to-try policies for games on Ouya.
In a statement to Kotaku, Ouya claimed the video was not an official ad for the console. It later stated however that “Ouyas”, where the promo was originally uploaded, was the company’s official YouTube channel.
“We are experimenting with animated content and posted this video briefly to get feedback from our community. Stay tuned for our official video!”

Riddled with attacks via banking, data, dating and beyond.
Android has always been accused of security problems due to the open source nature of its design, and McAfee Labs says the malware threats on the Google OS in Q2 rose by 35 per cent year-on-year.
The attacks are coming in a plethora of forms, such as: SMS-stealing banking malware, fraudulent dating and entertainment apps, weaponised legitimate apps and malicious apps posing as useful tools.
Banking violations are happening with hackers stealing usernames and passwords, then intercepting verification codes that are being sent from the bank to the consumer via text.
Meanwhile, those unlucky in love have been scammed by people paying for services that don't exist.
It seems Trojan apps are the worst ones to watch out for however, with real apps being converted to act as spyware and collect data – call logs, contacts, location, texts – from devices.
Vincent Weafer, SVP, McAfee Labs, said: "The mobile cybercrime landscape is becoming more defined as cyber gangs determine which tactics are most effective and profitable.
"As in other mature areas of cybercrime, the profit motive of hacking bank accounts has eclipsed the technical challenges of bypassing digital trust. Tactics such as the dating and entertainment app scams benefit from the lack of attention paid to such schemes; while others simply target the mobile paradigm's most popular currency: personal user information."

A video of Apple’s budget model iPhone 5C has appeared on YouTube, while separate rumours have placed the iPhone 5C’s price at £230.
The video titled ‘iPhone 5C rear shell scratch test’, which you can view below, shows an iPhone with a back similar topreviously leaked photos of the iPhone 5C.
The phone is placed inside a bag with keys and coins, in order to simulate an owner’s pocket, before being shaken around.
Emerging seemingly unscathed from the bag, the iPhone is then rubbed with a set of keys.
The iPhone’s back is shown close-up after the tests, twisting to reveal any scratches or dents, but the rear shell appears to be completely untouched.
In separate rumours, the 5C’s price has been rumoured by analysts. Website Know Your Mobile has posted statements from KGI analyst Mingchi Kuo, who also claims that the 5C will probably replace the existing iPhone 5, with the iPhone 4S’ cost dropping to cater to a budget market, while the iPhone 4 may disappear alongside the 5 due to its incompatibility with iOS7. Despite this prediction from Kuo, however, Apple states on its iOS7 website that the iPhone 4 will be supported.
Concerning the price of the 5C, Kuo suggests that the phone will sit in the mid-range of the market, with his company estimating the price to be between $400 and $500, which would make the British cost between £230 and £320.
Kuo also places the as-yet unannounced release date of the 5C to be October in China, with the rest of world following later this year.
If accurate, the dates would place the phone’s launch much later than current rumours, which instead schedule both the iPhone 5C and 5S for release on September 20th.

The indiegogo project for the Ubuntu Edge has failed to reach its target of $32 million, losing the largest amount ever pledged by crowdfunders.
The Linux-based smartphone, which aimed to function as a dual smartphone-and-desktop-PC device, received nearly $13 million in pledges from backers.
However, the considerable sum, the biggest ever offered by backers to a crowdfunding project, was still short by $19 million by its August 21st deadline, meaning that all $13 million will be returned to donators, as is standard with crowdfunding sites such as indiegogo and Kickstarter.
The largest ever successful crowdfunding project remains the Pebble Smartwatch, which raised over $10 million, but only needed $100,000 to receive the money.
The biggest backer of the failed Ubuntu Edge project was Bloomberg, which offered $80,000 in return for a hundred of the Edge smartphones. Nearly 20,000 other backers, including celebrity tech-lover Stephen Fry, coughed up the $700 for the Edge, which was due for production and release in 2014.
In an optimistic post-mortem post on the Edge’s indiegogo page, Mark Shuttleworth, who acts as a leader for the Ubuntu platform and who proposed the Edge, thanked supporters and stated that ‘the big winner from this campaign is Ubuntu,’ mentioning the number of Ubuntu-based phones that would be appearing in 2014, partly boosted by publicity surrounding the Edge.
Shuttleworth also praised crowdfunding, saying that ‘it’s a great way to give consumers a voice and to push for more innovation and transparency in the mobile industry,’ and suggesting that ‘perhaps one day’ he and the Edge team may return and ‘try it all over again.’

Mobile phones designed to look like car key fobs may be banned in the UK, with officials concerned about their safety and illegal presence in prisons.The devices, which are being made in China, have been seen attached to adverts showing prisoners, with one of the miniature mobiles boasting on Amazon of its ‘very low metal contact […] due to metal content alarm’ and another claiming to be ‘easily concealable’.The apparent focus of such adverts on the phones’ use in prison has officials concerned, with one prison service spokesman telling the BBC that it was increasing efforts to detect any such devices, with the number of recorded seisures increasing.Mobile phones are not allowed in prisons, with 7,000 phones and SIM cards confiscated in 2012.Many of the phones use their similarity in shape and size to car key fobs to capitalise on peoples’ interest, displaying well-known logos of car manufacturers, the use of which the UK’s Society of Motor Manufacturers and Traders believes to be illegal.In addition to the questionable legality of the phones’ design, the UK’s National Trading Standards Board has also said that the devices were very likely to be ‘unsafe’, as they were not tested, and could catch fire or electrocute users, leading the NTSB to urge people not to buy them.http://www.pcr-online.biz/news/read/...nes-ban/031734

Android game console company Ouya appears to have released and pulled an advert promoting its console over "crappy" games such as "Medal of Duty".
The advert, which was originally published on the official Ouya YouTube channel but has since been pulled, features an animated male character complaining about buying "exactly the same game" again, before vomiting an ankle-high pool of bile, ripping out his own spine and beating himself over the head with it.
"Stop wasting cash on crappy games," the advert says, pointing out that hundreds of games are free to try on Ouya. After it was pulled, NeoGAF user Wario64 re-uploaded the video along withevidence it was originally posted on the Ouya account.
Every game released on Ouya must have a free element, whether it's a demo or a totally free game with purchasable in-app items.
In late July, a month after the console launched, Ouya CEO Julie Uhrman said 27 per cent of Ouya owners had purchased content.
In our Ouya review we said there's plenty of things the system must overcome before it can truly be considered a viable alternative to other gaming hardware.

We can't say we're in love with Samsung's Galaxy S III mini, especially with a next-gen model already official. But if today's @evleaks post is to be believed, last year's not-so-brightest star in the Galaxy will be coming to AT&T. The date on the render up above is fixed on August 23rd, which is when we're expecting the Galaxy Mega tomake its US debut, so there's a chance we might see the GS III mini then as well. Still unknown is why AT&T would be bringing a humdrum 2012 handset to subscribers this late in the game, but if it does hit retailers this summer, it better come in with a MSRP far below handsets we'd actually recommend. Like, say, the Galaxy S 4.

Full HD displays? Eat your heart out, handset manufacturers. LG Display has just laid claim to the world's first Quad HD (2,560 x 1,440) smartphone display, which also boasts the highest pixel density of a mobile device, clocking in at 538ppi. The firm's panel measures up at 5.5-inches and is only 1.21mm thick, and just 1.2mm at its bezel. According to LG, that makes it the world's slimmest and narrowest panel, stealing the crown from hardware it showed off last month. Thanks to its use of AH-IPS tech and Low Temperature Poly-Silicon (LTPS) substrate, the screen features 430 nits of brightness. If the Quad HD math is throwing you off, that's four times as many pixels as a 1,280 x 720 display. This isn't 4K on a portable display, but we'll take it.
