Rudy Giuliani had John Gotti to worry about; Mike Bloomberg has Steve Jobs. Despite all-time lows for the city in homicides and shootings, NYC Mayor Michael Bloomberg said overall crime in New York City was up 3.3% in 2012 due to iPhone, iPad and other Apple device thefts, which have increased by 3,890 this year. 'If you just took away the jump in Apple, we'd be down for the year,' explained Marc La Vorgna, the mayor's press secretary. 'The proliferation of people carrying expensive devices around is so great,' La Vorgna added. 'It's something that's never had to be dealt with before.' Bloomberg also took to the radio, urging New Yorkers who didn't want to become a crime statistic to keep their iDevices in an interior, hard-to-reach pocket: 'Put it in a pocket in sort of a more body-fitting, tighter clothes, that you can feel if it was — if somebody put their hand in your pocket, not just an outside coat pocket.' But it seems the best way to fight the iCrime Wave might be to slash the $699 price of an iPhone(unactivated), which costs an estimated $207 to make. The U.S. phone subsidy model reportedly adds $400+ to the price of an iPhone. So, is offering unlocked alternatives at much more reasonable prices than an iPhone — like the $299 Nexus 4, for starters — the real key to taking a bite out of cellphone crime? After all, didn't dramatic price cuts pretty much kill car stereo theft?

Ars Technica reports that "On Friday the ITC filed a redacted version of a remedy suggested by ITC Administrative Law Judge Thomas Pender, in which he recommended a ban be enforced against Samsung products that were found to infringe upon four Apple patents. The judge also recommended that Samsung post a bond for 88 percent of the value of its infringing mobile phones, as well as 32.5 percent of the value of infringing media players, and 37.6 percent of the value of infringing tablets." That sounds like a clear loss for Samsung, but the judge "also approved several workarounds suggested by Samsung that might permit the company to continue selling the implicated products (which include the Transform, Acclaim, Indulge and Intercept smartphones, according to Computerworld). These workarounds would sidestep infringing on Apple's four patents—which include one design patent and three technology patents." Ruling and remedy have yet to be approved by the panel whose word would make them final.

If you're keeping track of the multiple, and let's face it, tiresome Samsung / Apple patent debacle, a document that just turned up at the ITC might spell more trouble for the Korean manufacturer. It's a publicly redacted version of Judge Pender's recommendations, and pertains to the October ruling that deemed Samsung borrowed four of Cupertino's designs. The most iconic being design patent D618,678 (that which you see above). The others include multi-touch patent 7,479,949 (which was tentatively invalidated) along with two other patents (RE41,922 and 7,912,501) relating to graphic display elements and audio hardware detection. If the recommendations are adopted -- and FOSS Patents suggests this is entirely possible -- Samsung could face a US import ban after a 60 day presidential review, an order prohibiting "significant" sales of infringing products in America along with a posting a bond for 88 percent of the entered value of mobile phones (plus 32.5 percent for media players and 37.6 percent for tablets) that include the breaching design features. Pender has, however, reportedly cleared several Samsung "designarounds" which, if implemented to satisfaction, would mean the tech giant could continue trading. For now though, the recommendations are awaiting the Commission's review.

It's a little early for an Ouyateardown, but Kickstarters who chipped in $699 won't have to wait long to see what the little console is made of -- Ouya's developer hardware is transparent. The console's team decided to cut the inevitable march of unboxing videos off at the neck, offering fans a quick preview of the package it's shipping out to devs. The standard accoutrements are there -- the tiny console itself, two prototype controllers with batteries, HDMI and power adapters, plus a micro USB cord and a letter to developers thanking them for their investment and warning them of the early build's bugs. The note also cautions deep-pocketed gamers that the device is built specifically for developer use, and has no games to placate eager couch potatoes. The video shows the console booting up, and even demonstrates how easy it is to open the hardware. Samsung gave Galaxy S III buyers a small rainbow of color choices in the summer, and there's signs that the Galaxy Note II might receive a similarly resplendent treatment. A supposed press image obtained by AndroidSlash shows the giant smartphone draped in a previously unavailable black that's potentially very striking -- and more than a little reminiscent of2001's species-changing monoliths. There's no official word from Samsung on its authenticity, although we wouldn't be surprised knowing the company's history and the Note II's strong track record. When a theoretically niche device is selling like gangbusters, some added diversity could be in order. Just don't expect any Starchildren as a result.

Apple's patent claim against Samsung's Galaxy S III mini is no more, with Cupertino citing the phone's lacking availability in the US for the amendment to its original November filing. In the ongoing litigation between the two electronics giants, Samsung argued that it's Galaxy S III mini didn't warrant inclusion in the latest volley of Samsung devices Apple wants added to its patent lawsuit; Apple apparently agreed, and is thusly withdrawing its claim against that particular device. The argument also highlights the sad news that the S III mini won't join Samsung's Galaxy lineup in the US.
An agreement filing spotted by Reuters from a San Jose, CA. US District Court revealed today's news, coming just days afterJudge Lucy Koh dismissed a request to permanently ban saleson several Samsung devices. It's unclear if the other Samsung devices Apple asked to be added to the ongoing case are approved yet by the court, but we can certainly count the S III mini out for the time being.
