In the latest twist in their ongoing legal battle, Apple has been told it will not be able to include Samsung's Galaxy S4 device in its lawsuit.
Launching its second patent suit back in May, Apple involved a number of Samsung's devices, including the Galaxy S3 and Galaxy Note 2, but had hoped to also include the firm's flagship device, the Galaxy S4.
However, despite offering to drop its suit against another of Samsung's devices involved in the court case, US Magistrate Judge Paul Grewal has dashed these hopes, refusing to incorporate the device into the ongoing case.
Instead, Grewal advised that if Apple did want to pursue the Galaxy S4 within a patent suit, it would have to file for a new case.
"Each time these parties appear in the courtroom, they consume considerable amounts of the court's time and energy, which takes time away from other parties who also require and are entitled to the court's attention," said Grewal.
"Judge Koh has been explicit with both parties that this case must be streamlined, which requires reducing the number of products and patents at issue - not increasing them.
"The number of products may be the same, but as the court described, the potential disputes revolving around Galaxy S4 are greater than whatever product it will replace because of its late addition," the judge continued.
As the seemingly never-ending case continues, the next battle between the two firms is set to take place in February 2014.

The web giant is reportedly developing both an Android-based games console and wristwatch as it looks to bolster its position outside of the smartphone and tablet markets.
A report from The Wall Street Journal cites unnamed sources "familiar with the matter" and indicates that Google is working on the new devices, in addition to readying a new edition of its media-streaming device, the Nexus Q.
It's unsurprising to see Google look to build upon the already dominating success of the Android platform with new avenues, particularly within the gaming market and increasingly prominent wearable tech category.
The move is also likely a response to potential moves being made by rival firms, particularly Apple, which is also believed to be hard at work on a smartwatch device of its own, whilst an Android-powered console could rival the Apple TV.
With a host of Android-based micro-consoles on the way, including the recently released Ouya, and the now-delayed Nvidia Shield, a Google branded console would likely position itself to compete with these devices.
Of course, with the Android platform already powering 75 per cent of smartphones and 57 per cent of tablets globally, the decision to release new device is as simple as Google wanting to further expand the Android brand.
As for next year? Expect an Android-based toaster.

A duo in Seattle has invented an iPhone accessory that can turn your smartphone into a 3D camera.
Ethan Lowry and Joe Heitzeberg have set up a Kickstarter campaign for ‘Poppy’ – a device which captures 3D photos and video clips by combining two stereographic images via the iPhone’s single camera.
The campaign started on Wednesday and reached its initial $100k goal in under nine hours, but those interesting in supporting the project have until July 26th to pledge. These users will still be able to get in on the discounted Kickstarter pricing.
As well as just having fun with the usual stuff you take photos and videos of, Poppy believes there are many possibilities for the product such as real estate and architectural walk-throughs.
With YouTube adding support for 3D in 2009, there is a huge library of movie trailers, music videos, sport clips and user-generated content that Poppy users will be able to take advantage of.

Professor Layton series developer Level-5 has launched Layton Brothers Mystery Room, a crime-solving "interactive mystery novella" for the iPhone, iPod Touch, and iPad.
Layton Brothers stars Inspector Alfendi Layton and his assistant Detective Constable Lucy Baker, who must work together to solve a series of grisly murders. Players will need to carefully examine crime scenes for clues in order to sniff out suspects and establish motives.
Layton Brothers also seems to share the same quirky charm that defined the Professor Layton series; as part of the game's first case, you'll need to disassemble a deadly sandwich. Was the lettuce laced with poison? Or does the pickle have something to hide? Don't forget to interrogate the bread, if that's an option.
The core Layton Brothers app is a free download that includes two cases to solve. Seven additional cases are available as in-app purchases.

Google is developing a game console that runs on Android, Wall Street Journalreports. The console is in development alongside a wrist watch powered by Android.
Google is interested in the console and watch as a buffer against whatever devices Apple has planned for the future, the report says. One person mentioned that Google has been watching the Ouya, the Kickstarted and open Android console that just launched to the public for $99 a pop. Amazon sold out of its Ouya stock early in the first day, but is back in business now.
As for the watch, wearable computing isn't a new idea – it's one that Valve founder Gabe Newell in particular finds intriguing. Valve is working on a Steam Box, which is so far described as a cheap, in-home streaming console that runs on Linux. Newell, like Google, is also keeping a close eye on Apple.

Port space is very limited on laptops, but Apple has just received a patent that could solve that problem in the simplest way possible: cramming two ports into one. Expanding on what we've seen with some multi-format card readers, Apple has designed a layered port whose staggered electrical contacts and overall shape let it accept two different connectors. While the company uses the combination of a USB port and SD card reader as its example, the patent could theoretically apply to any two technologies that make sense together. The real question is whether or not Apple will use its invention at all. The Mac maker has a few slim portables that could use some expansion, but there's no evidence that the company will tweak its computer designs in the near future.

According to the Wall Street Journal, Google might make another foray into living room hardware as it's currently developing an Android powered gaming console. Since that's just not enough of a rumor bomb, the talkative "people familiar with the matter" also claim a wristwatch and followup to its "postponed" Nexus Q project are on the way. If you believe the rumors, its reason for jumping into all these categories is to beat products Apple is reportedly developing in the same categories, with at least one of them launching this fall. Finally, the leaks indicate Google's next major Android update will be "tailored to low-cost devices in developing countries."

John Morris at CNET offers a brief review of PC Android devices, many of them hybrids running Windows 8 and Android. From the article, 'Microsoft has spent a lot of time and effort trying to get Windows onto smartphones and tablets — so far without a whole lot to show for it. Now several PC companies are trying the opposite approach, taking the Android operating system and porting it to PCs.' The article reviews the recent releases from HP, Acer, Asus, and Samsung. Does Android creeping onto desktop or 'traditional' PC devices have any kind of possible long term consequences? Could this be a way for Android and Google to develop a larger presence in corporate IT, or could Android ever really supplant the Windows foothold?

Idealo releases data on the larger than life phablet market.
The definition of a phablet, as stated by Idealo.co.uk, is 'a smartphone, which has a screen measuring between five and seven inches in diameter.' Or a really big phone, which is technically what it is!
According to a survey released by Idealo, there has been a steady increase in the sale of phablets since 2011. The screen size of devices as well as the demand for larger screens has also seen a significant growth over the last few years.
There has been an overall 501 per cent increase in clicks on phablets since May 2012, also with a steady influx of phablets introduced into the smartphone category. This was displayed via the shear number of click-throughs on a phablet device which has risen from 2.74 per cent in 2012 to just over 13 per cent by April 2013.
This has certainly shown a larger consumer interest for larger screen devices, plus a response from manufacturers to bring more of these types of machines onto the market.
There are six times more phablet models listed on the Idealo site compared to 12 months ago, with average prices decreasing due to the demand. Prices have steadily been lowered from up to around €480 in 2012 to below €400 in 2013. However, the higher end of the market is still proving to be most popular.
This could mean that the previously struggling 'big smartphone' or phablet as it is now commonly known, has established itself in the mobile market. Or is this just a mini-disc style phase that will eventually peter out when consumers lose interest?
If Idealo's findings are anything to go by, it would appear that these larger devices are staying, and not only have they got their heels firmly dug into the ground, but it seems as though they plan on getting bigger. Especially with rumours of Apple jumping on the band wagon with an 5.7 inch screened iPhone possibly on the horizon.

The world's first fully integrated smartwatch has officially launched.
Steven Jobs step aside; Bill Gates sit down; there appears to be some exciting new players entering the gadget playing field, as Androidly, the worlds first smartwatch powered by Android, has been unveiled and released by its four creators - who are all under 25.
All other smart watches so far seem to have fallen short of consumer expectations, which is where the guys behind Androidly say their gadget steps up. The device can be loaded with up to 100,000 apps from the Google Play Store, has a video camera, Bluetooth, built in Wi-Fi, GPS and even a USB port on its strap.
This swiss army wrist decoration can also be used to make calls with its speakerphone or a bluetooth headset.
A 416Mhz processor drives the watch, which has 256 MB of RAM and up to 16GB of expandable memory. Androidly will be the smallest device in the world to run completely on Android.
WIth this smart watch - that its developers have called a 'digital limb' - users can download apps and music via Wi-Fi or 2.5G, and can stream media to an integrated Android device through Bluetooth. It can notify the user of news headlines, send and receive emails and deliver Twitter and Facebook feeds directly to your wrist.
Documents and contacts can be reached without the original device to hand, and its GPS can even display the weather for any desired destination.
After the announcement of the Sony SmartWatch 2, which probably didn't cause as much excitement as had been hoped, and Google and Apple highlighting the development of their watch phones, this - considering Androidly's creators ages, and how advanced this device appears to be - could have gadget junkies quaking in their crocs.
Self taught inventor Siddhant Vats, co-founder of Androidly, said: "Androidly is the world's first proper smartwatch in the true sense of the word. It has the unrestricted powerful flexibility of Android which lets the consumer free his world and not be dependant on the smartphone as the functionalities are enabled on the smartwatch!"
Most of the apps for the robo-bracelet are free to download and the device itself is available on Kickstarter and the company website for £150.

Samsung has confirmed the Galaxy S4 mini will launch on June 29th with a price tag starting at £365.
Unlocked Mobiles is set to offer the handset SIM-only for £365, whilst High Street specialist Phones4U has begun accepting preorders for the device with a hefty price tag of £420.
The modest device, which is the latest spin-off of Samsung's flagship Galaxy S4 device, sports a 4.3-inch AMOLED display, 1.7GHz dual-core Snapdragon processor and 1.5GB of RAM, in addition to an eight-megapxiel camera and up to 8GB of onboard storage space.
As simply a scaled down edition of the original Galaxy S4, it will be interesting to see if consumers opt for the device, particularly with a not-so-mini price tag.

A newly secured patent by Apple indicates the firm may be looking to update its MacBook range with a second touch panel.
Wording of the patent suggest that Apple may be looking to incorporate a touch screen to the lid of the MacBook, which work function much like an iPad or any other tablet.
In particular, the patent describes "A system including a capacitive array element capable of sensing touch from either side is described."
More interestingly, however, is the portion of the filing that states: "The track pad device may include a display element and the capacitive array element may be translucent."
That would suggest a MacBook device which sports a traditional keyboard, however, a touch screen that is functional when the lid of the device is closed.

Microsoft has signed a deal with Telefonica, owner of O2 within the UK, in order to push the Windows Phone brand more effectively to its customers.
The 'strategic marketing agreement' forged between the two firms is one that both parties hope will put an end to the iOS and Android 'duopoly' of the current smartphone market.
"With this arrangement Telefónica reinforces its commitment to improve the current balance of mobile operating platforms on the market, encouraging it to be more diverse and less of a duopoly," reads the company's press release.
"Promoting the use of Windows Phone 8 will benefit customers, as there will be more options to choose from while diluting the polarisation of installed base in operating platforms."
It's a smart decision by Microsoft, which continues to discover new avenues of boosting the market share of its Windows Phone platform. It is hoped that higher awareness of Windows branded handsets in store will lead to a rise in the firm's eight per cent smartphone market share.

Samsung's dinkier S4 variant will be available to buy in the UK, starting next week. Phones 4U promises that it'll be posting its Galaxy S4 Mini preorders on Monday July 1st, while smaller phone sellers like Unlocked Mobiles and Handtec are promising to start sales this weekend. Launching priced at £420 in Phones 4U, it's arriving at a higher cost than last year's Galaxy S III, currently £400 on the same site, making the S4 Mini (barring those looking for an incrementally smaller phone) appear a very tough sell to customers. While borrowing some design cues from the Galaxy S 4, the Mini drops down to a 1.7GHz dual-core processor and a pretty underwhelming 4.3-inch qHD AMOLED display, both less than you'd get on the GSIII. Of course, the pricecould drop substantially after release and EE is already offering S4 Mini preorder customers a free Galaxy Tab 2 7.0 to sweeten the deal.

Codemasters’ cult rally franchise Colin McRae is to return!
Having evolved into the Dirt franchise on consoles and PC, the Colin McRae IP proper will tomorrow be resurrected on iOS, Pocket Gamer reports.
The game is apparently based on Colin McRae Rally 2.0. It features 30 stages and over 130km of track. Vehicles include the Subaru Impreza, Ford Focus, Mitsubishi Evo VI and Lancia Stratos.
Also returning is co-driver Nicky Grist who will deliver verbal pace notes.
The game will cost £2.99 in the UK.
The first Colin McRae game was released in 1998 and the series continued all the way up to 2008’s Colin McRae Dirt 2. The next game in the series, Dirt 3, was the first to drop the name.
Colin McRae was a highly successful Scottish rally driver until his death in 2007 at the age of 39.

The Nvidia Shield console won’t be hitting shelves this month as originally planned, thanks to a mechanical issue in the eleventh hour.
Nvidia’s Jason Paul posted on the company’s official blog, revealing that the Android-powered handheld device will miss its retail launch today and won’t be out until sometime in July.
"We won’t [release the device] until it's fully up to the exacting standards that NVIDIA's known for,” Paul wrote. “And some final quality-assurance testing has just turned up a mechanical issue that we’re not happy with.”
“So, while we announced last week that SHIELD will go on sale this Thursday, we’ve taken the hard decision to delay shipping until next month.”
Paul explained that the mechanical issue in question relates to the integrity of a third-party component, something that was significant enough for the team to postpone the hardware’s launch.
“The issue relates to a third-party mechanical component, and we’re working around the clock with the supplier to get it up to our expectations.”
Shield is a mini-console that brings together a console-style controller and a 5-inch flip-up screen with 720p and multi-touch support. It runs $299, carries 2GB of RAM, and is powered by Nvidia's Tegra 4 mobile CPU/GPU combo and the Jelly Bean version of Google's Android OS.

Limbo will be released on iOS on July 3, developer Playdead has confirmed.The cult adventure has also now sold over three million copies from its various releases on PS3, Xbox 360, Steam, Mac App Store and Playstation Vita.The new iOS port required a rethinking of the controls and “extensive optimisations” for iPhone, iPad and iPod Touch, Playdead said in a statement. It has been on the cards for some time now, that some form of smartwatch was undoubtedly going to emerge from one of the tech giants.
With the Apple iWatch previously rumoured, it appears that Sony has beat them to the punch by unveiling what could be the first ever 'real' smartwatch, reports Tech Radar.
Sony has described the futuristic time keeper as 'a second screen for your Android phone,' but at 1.6 inches and 220x176 pixels, you may find your self straining to see it.
Features of the watch will allow you to take calls, check maps, read previously downloaded emails and control music… Oh, and tell the time too. You will also be able to take photos through your phone with a specially developed smart camera app.
Sony's SmartWatch 2 will be compatible with 'most' Android smartphones and will come with an interchangeable 24mm wristband. The predicted release date for this wrist-gadget is set for September 2013, with no current price mentioned.
