The Free Software Foundation has discovered that an application currently distributed in Apple's App Store is a port of GNU Go. This makes it a GPL violation, because Apple controls distribution of all such programs through the iTunes Store Terms of Service, which is incompatible with section 6 of the GPLv2. It's an unusual enforcement action, though, because they don't want Apple to just make the app disappear, they want Apple to grant its users the full freedoms offered by the GPL. Accordingly, they haven't sued or sent any legal threats and are instead in talks with Apple about how they can offer their users the GPLed software legally, which is difficult because it's not possible to grant users all the freedoms they're entitled to and still comply with Apple's restrictive licensing terms.

iPhone maker Apple has surpassed Microsoft to become the world's most valuable technology company, according to the latest Wall Street evaluations.
On Wednesday Apple was valued at $222.12 billion and Microsoft at $219.18 billion, with the only American company valued higher being Exxon Mobil at $278.64 billion.
Revenues for Apple stand at $42.9 billion, with Microsoft at $58.4 billion. There is a wider divide in net income though, with Microsoft making a profit of $14.6 billion in its last fiscal year - compared to $5.7 billion for Apple.
The upset not only marks an individual triumph for Apple but also sees the dominant technology company change from one focused on business users to the consumer market.
As noted by the New York Times 172 million smartphones were sold last year, as opposed to 306 million PCs. However, smartphone sales are growing at more than five times the pace.
Of the two companies Microsoft remains by far the most invested in the video games industry, with both the Xbox brand and continued support for Games for Windows.
Apple has traditionally been far less engaged, although the release of Steam for Macintosh computers and the launch of the App Store for the iPhone and iPad has allowed third parties to make Apple hardware increasingly viable games formats.

UK broadcaster Sky has updated its iPhone mobile TV app to run on the iPad too, offering several channels for streaming over Wi-Fi.
The iPad version offers better quality streams of Sky Sports 1, Sky Sports 2, Sky Sports News and Sky News, although users are advised to be using a Wi-Fi connection with at least 2Mb per second.
How much to watch Sky on your iPad? £35 a month for people who aren't already Sky subscribers, and £6 a month for people who are. There will be free trials.
The app is being released for UK and Irish residents only, and is live on the App Store now.
It's already attracted several one-star reviews on the App Store, with users complaining about the £35 monthly price point.
"£35 for iPad viewing each month? Someone is having a laugh here, but it's not me," is one comment. The main issue appears to be the fact that iPhone and iPod touch users pay just £6 a month.
Last night, Sky's general manager of mobile David Gibbs was distinctly lukewarm on iPad's importance, speaking at ME's Monetising Mobile conference.
"For a media or entertainment company it's very interesting. But at the moment it's an interesting niche," he said.

Apple's iBooks application for iPad is now available internationally - or at least on the UK App Store, from where we've just downloaded it.
The app lets iPad users browse Apple's catalogue of e-books, download them and then read them on the tablet device.
You'll notice we didn't say 'purchase' there. That's because for now, the iBooks store doesn't have any paid titles here in the UK.
Instead, it's offering a range of classic books, including fiction and non-fiction, as free downloads.
Apple is either still tying up licensing deals with the various book publishers for the UK, or it's still grappling with the implications of whether its agency model deals with publishers are even legal here.
Happily, as in the US, the app comes with one free download: a Winnie the Pooh e-book. Currently riding high in the UK iBooks free books chart are The Three Musketeers, The Art of War, Great Expectations and The Picture of Dorian Gray.
It's possible, of course, that a wodge of paid e-books will be added to the store tonight, in readiness for iPad's official UK launch tomorrow.

Square Enix quietly released Chocobo Panic on iTunes. No, it’s not chocobo RPG. It’s a chocobo catching game for iPad.
Chocobo Panic has players touch colored chocobos to hold them until the game tells you to “let go!”. The game takes advantage of the iPad’s multi-touch screen since players can use up to six fingers to catch chocobos. Sounds something like finger Twister with moving dots. Chocobo Panic also has a two player mode and keeps track of your high score.
Chocobo Panic is Square Enix’s second iPhone game. Their first? Morita Shogi HD. You can Chocobo Panic plus a stable of blue, red, yellow, and forest loving black chocobos for $3.99.

Rockstar has released a 'Lite' version of Grand Theft Auto: Chinatown Wars on the App Store.
This is essentially a demo or free trial for the £6 iPhone and iPod Touch game.
Chinatown Wars Lite contains the first three levels of the game. These introduce you to the underworld of Liberty City, and to Uncle Wu "Kenny" Lee: a man on a dangerous quest to overthrow the city's Triad gangs.

A survey conducted by East Carolina University Psychophysiology Department is finding that playing PopCap's games, such as Bejeweled and Peggle, improves cognitive function. PopCap has highlighted the fact the the study, which has been underway some six-months, is in no way underwritten by the giant of casual gaming.
The Psychophysiology Lab and Biofeedback Clinic at ECU's director Dr. Carmen Russoniello is presenting initial data and analysis from the study today at the 6th annual Games for Health Conference in Boston.
“The initial results of the study are very intriguing, in that they suggest that the 'active participation' required while playing a casual video game like Bejeweled provides an opportunity for mental exercise that more passive activities, like watching television, do not,” said Russoniello. “Future applications could include prescriptive applications using casual video games to potentially stave off Alzheimer's disease and other dementia-type disorders.”

Football Manager Handheld for the iPhone and iPod Touch will be made available in Japan on June 4.
Sports Interactive studio director Miles Jacobson has just tweeted, "For those of you in Japan, Football Manager Handheld will be available in the iTunes app store from June 4th (in English)."
The European version of Football Manager Handheld on the iPhone and iPod Touch was released in April.

Revolution Software adventure game Broken Sword: The Directors Cut has today been released for the iPad. The same version as released on the DS, Wii and iPhone, and features extra puzzles and artwork not included in the 1996 PC original.
The iPad addition also includes its own unique content; primarily in the form of a digital Broken Sword comic by Watchmen artist and co-creator Dave Gibbons, which has never before seen release in virtual form. The iPad edition also boasts higher resolution visuals than its iPhone predecessor.
"This really is the definitive version," said Revolution Software's managing director, Charles Cecil. "Rather than rush the game out for the US launch, we have taken the time to get it just right, and with the higher resolution graphics, and the addition of the digital comic as a bonus feature, there's a lot of new content to enjoy. We are thrilled to be able to release the game to coincide with the European launch of the iPad."
Revolution Software's globe hopping murder mystery is available now for £4.99 for the iPad.

Apple may be a despot of its own walled garden, but that doesn't mean it's not benevolent. The iPad's international launch on May 28 has prompted the company to open Stores an hour early, at 8AM local time, in order to give its devotees a reprieve from hours of queuing outside. Then again, that little asterix up there points us to an ominous "while supplies last" note at the bottom, which together with current pre-orders being fulfilled at some unidentified point in June, might force the most impatient to just get to the Store even earlier. UK buyers will get an alternative option thanks to Dixons Group stocking Apple's slate in Currys and PC World outlets, an arrangement that we keep hearing might be exclusive for the first sixty days after launch. Either way, you've been warned, don't be tardy if you wanna be trendy.
P.S. The iBooks app has also made its debut outside of the US today, though at present it's limited to just freebie titles, and the iBookstore is still described as "US only."
Update: The latest we're hearing is that at least some Apple Premium Resellers will also be getting stock of the iPad in the UK -- worth checking out if other options sell out.

Yes, the "iPhone 3G is dead" rumors are flying fast, and our latest entry is hardly a rumor: Apple's online store currently lists the solitary 8GB iPhone 3G next to the full iPhone 3GS crop, but there's no longer a tasty "select" button below it. Usually if something's out of stock on the Apple store it will just say so, along with a projected time of delay, but with the 4G presumably around the corner this could indeed be marking the end of the 3G's last stand.

Unfortunately, we don't know much about this new Marvell powered tablet, but we couldn't resist sharing our impressions of the very svelte 10-inch device. We only got a few minutes to play around with the slate at the Netbook Summit, but we can tell you that it has a brushed metal back and there's an opening on the front for a camera. As for the internals, it's based on Marvell's Moby reference design, which uses its Snapdragon-class Armada 610 processor, and will run Android 2.1 Eclair. The rest will be up to whatever Marvell customer is bringing this bad boy to market -- the Marvell executive that let us catch a glance at the device wouldn't turn it on as he feared we may see the mystery customer's logo. We told you we didn't know much, but from what we saw today it sure looks promising. Now, if only we felt Android was ready for these tablets...

South Korea-based studio Lemon has signed a publishing deal that will see its smartphone MMO released across multiple platforms. Lemon says its game, Fantasia, cost $4.5 million to build; relatively sizable funds required to bring MMO PvP gameplay to mobile devices.
Com2uS has stepped in as publisher for the game, in a deal worth 3 Billion Won.
Lemon says that the volatile growth of smartphone market – and the devices’ adoption of WiFi – means that the platform will expand from its roots in single-player game design, eventually adopting the kind of online-focused gaming commonly found in home consoles.
“It took 4 years and US$ 4.5 million to develop Fantasia,” said Lemon CEO Hyo-Sung Yoon.
“I am positive that Fantasia will become a killer game content for smartphone with its profound storyline and quality gameplay.”
A closed Beta for Famtasia will launch later in the year.

Nokia has released an over the air software update for its N900 handset, providing access to new content from the Ovi store and various add-ons.
The new capabilities of the PR1.2 software include Skype video calling, Facebook IM chat, portrait browsing and updates to email and calendar tools.
Among the new apps available for the N900 from the Ovi store are Jurassic Rollercoaster 3D, QuickPanorama Pro, Angry Birds level pack and Sygic Mobile maps.
Nokia says that once PR1.2 rollout is complete Ovi Store will no longer support older Maemo5 versions of the N900.

Microsoft's Entertainment & Devices division could be in line for "major organisational changes" as soon as this week, according to a report in the Wall Street Journal.
The division includes Microsoft's Windows Phone operation, along with Zune and Xbox. The WSJ suggests that executives could be on the way out, including chief experience officer and CTO J Allard.
The report points to "increasingly bruising competition" from Apple and Google as a prime factor in the reorganisation.
However, it wouldn't be a surprise if Microsoft wanted to make changes, as it tries to forge closer links between the different bits of this particular division.
Zune will supply the music and entertainment aspects for Windows Phone 7, while Xbox will provide the gaming platform.

The results show a clear issue when Adobe Flash plugin is enabled on the Nexus One phone. Not only the speed of loading pages in slow but also scrolling on pages is not smooth. Also, it looks like Adobe Flash plugin takes way too many resources causing the device to display Memory Low warnings. On pages without Flash, or when the Adobe Flash plugin is not enabled, Nexus One with Android 2.2 is definitely faster from the other browsers. Safari on the iPhone will get a boost with the introduction of the next generation iPhone in a few days. Next generation iPhone is expected to include the same A4 processor found in iPad. The battle between Apple and Adobe is well documented with Apple’s CEO Steve Jobs calling Adobe “lazy” in working to fix performance of Flash in mobile devices. In addition, in his public letter explaining why Apple is restricting Adobe Flash in iPhone OS 4, Jobs said that Adobe Flash performs poorly. “We have routinely asked Adobe to show us Flash performing well on a mobile device, any mobile device, for a few years now. We have never seen it,” Jobs said.

Android 2.2 and Flash 10.1. A perfect combination for combination for a little Hulu on the go, right? Not quite, as Hulu has decided to block videos (for legal reasons) when it detects a mobile device, but it turns out there is a surprisingly simple workaround. As Absolutely Android explains, all you have to do is make Hulu think you're using a desktop browser, which can be done simply by entering "about:debug" in the address bar and switching the UAString setting from Android to desktop. The only downside to the trick is that you'll now also get the full desktop version of the Hulu site (and any other site, until you switch it back), and there's a better than decent chance that Hulu will close this loophole before you can finish your first episode of Kojak.

We're in an interesting position with Windows Phone 7. We still don't know what devices will be running the OS nor indeed exactly when they'll be launching, but despite that we've already had the opportunity to spend quite a bit of quality time with not one but two separate versions of Microsoft's mobile revolution. And now, if that weren't enough, we've gained access to a series of detailed architectural documents about the OS courtesy of tweakers.net and HTCPedia.com, documents that detail everything from ringtones to device drivers. It's a couple-hundred pages of generally menial stuff, but there are quite a few nuggets of gold to be found in here, and we've dug them out just for you.
